General Information about Accredited Organizations in International Adoption

The Accredited Organizations for International Adoption (hereafter OAA) are non-profit entities registered in the corresponding register, whose purpose in their statutes is the protection of children.

The OAA will carry out their activity throughout the national territory, providing their services to persons offering for adoption with habitual residence in Spain.

Their actions abroad will be limited to the country or countries for which they have been accredited, without prejudice to the fulfillment of the requirements and conditions that may be established by the country of origin of the minor.

In the exercise of their mediation functions in international adoption, the actions of the OAA will be limited to the activities specified in the accreditation resolution and must be carried out under the terms and conditions established therein.

  • Advice, training, and support to those offering for adoption on the meaning and implications of adoption, relevant cultural aspects, and the procedures that must be carried out in Spain and the countries of origin of the children.

  • Mediation in the processing of adoption offers between competent Spanish and foreign authorities.

  • Carrying out the necessary procedures for fulfilling post-adoptive obligations established for adoptive families under the legislation of the country of origin of the adopted minor, which will be entrusted to them under the terms established by the Spanish Public Entity where they reside.

The OAA will designate the person who will act as their representative before the authority of the country of origin.

After the entry into force of Royal Decree 573/2023, of July 4th, which approves the International Adoption Regulation, the accreditation of organizations interested in carrying out mediation functions in international adoption must be carried out according to the procedure established in the current regulations of the autonomous community where the organization has its registered office. This autonomous community will be the only one to which the organization may submit the accreditation request.

The public entities that have accredited mediation organizations will oversee monitoring and control functions regarding the general operation of the accredited organization in their autonomous community's territory, as well as those related to the activities they carry out in the country of origin.

The monitoring and control of the accredited organization that has carried out the processing of an adoption file will correspond to the public entities that have processed or are processing the file of those offering to adopt.

National Register of Accredited Organizations for International Adoption and Claims and Incidents

Chapter VI of Royal Decree 573/2023, of July 4th, which approves the International Adoption Regulation, provides for the creation of the National Register of Accredited Organizations for International Adoption and Claims and Incidents.

The Register consists of two sections:

  1. First section: Register of Accredited Organizations. This section is public, general, and free. However, access to the data regarding the composition of the accredited organization's technical team and its respective modifications, as well as the identity of the representative in the country of origin, can only take place when the existence of a legitimate interest is demonstrated.

  2. Second section: Register of Claims and Incidents. Access to this section will be granted, among others, to users of a mediation organization who have filed a claim or incident regarding the services provided by it, both in Spain and in the country of origin, as well as the recipient organizations of these, regarding the files they have processed.
